Terms and Conditions of Service

1. Agreement to Terms

By requesting or receiving services from Forman Lawn Management LLC (hereinafter referred to as "FLM," "we," "us," or "our"), you (the "Customer") agree to these Terms and Conditions. These terms apply to all services provided by FLM including but not limited to lawn care, landscaping, hardscape installation, irrigation services, snow and ice removal, and any other related services.

2. Scope of Services

FLM will provide services as agreed upon between FLM and the Customer. Any additional services requested by the Customer outside of the agreed-upon scope may result in additional charges. All services are subject to availability and weather conditions.

3. Estimates and Pricing

All estimates provided by FLM are free of charge unless otherwise stated. Estimates are based on the condition of the property at the time of inspection and may change if unforeseen issues arise. Prices are subject to change due to material cost fluctuations or additional labor required. Customers will be notified of any changes prior to work beginning.

4. Payment Terms

Payment is due upon receipt of invoice unless otherwise agreed in writing. FLM accepts payment in the form of cash and or check. Late payments may be subject to a late fee of 3% after 30 days. FLM reserves the right to suspend services if payments are not received in a timely manner.

5. Cancellation and Rescheduling

Customers may cancel or reschedule services with at least 48 hours' notice or until materials are ordered. Cancellations made less than 48 hours before a scheduled service or after materials are ordered, may result in a cancellation fee. FLM reserves the right to cancel or reschedule services due to weather, unforeseen circumstances, or equipment failure.

6. Property Access and Preparation

Customers agree to provide FLM with clear and safe access to the property. This includes but is not limited to removing personal items, unlocking gates, and securing pets. If FLM arrives at the property and cannot perform services due to lack of access, the Customer may be subject to a service call fee.

7. Damage Liability

While FLM takes all necessary precautions to avoid property damage, FLM is not liable for damages to underground utilities, sprinkler systems, personal property, or landscaping features not clearly marked or disclosed prior to service. Any damage caused directly by FLM’s negligence will be repaired or replaced at FLM’s expense.

8. Warranty and Service Guarantee

FLM guarantees the quality of its work for a period of 30 days after service completion. This guarantee does not cover damage caused by weather, misuse, neglect, or natural wear and tear. Any concerns must be reported to FLM within 30 days of service completion.

9. Termination of Services

FLM reserves the right to terminate services at any time if the Customer fails to adhere to these Terms and Conditions, fails to make timely payments, or acts in a manner that is abusive or unsafe toward FLM personnel, equipment, or property.

10. Force Majeure

FLM is not liable for delays or failure to perform services due to events beyond our control, including but not limited to extreme weather, natural disasters, equipment failure, or labor shortages.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which FLM operates.

12. Changes to Terms and Conditions

FLM reserves the right to amend or update these Terms and Conditions at any time. Customers will be notified of any significant changes in writing or via email.
